ridewhee.com provides family cargo bike subscription and leasing services in New York City. Our services include the provision of cargo bicycles, maintenance, and related support services on a month-to-month subscription basis.

3. Subscription Terms

3.1 Subscription Period

Subscriptions are offered on a month-to-month basis. Your subscription will automatically renew each month unless you cancel in accordance with our cancellation policy.

3.2 Payment

You agree to pay all fees associated with your subscription as described at the time of sign-up. Payment is due monthly in advance. We reserve the right to change our pricing with 30 days' notice to existing subscribers.

3.3 Cancellation

You may cancel your subscription at any time by providing at least 30 days' written notice. Upon cancellation, you must return the bicycle in good condition within the notice period.

4. Use of Bicycle

4.1 Proper Use

You agree to use the bicycle only for its intended purpose and in accordance with all applicable laws, regulations, and safety guidelines. The bicycle must be operated safely and responsibly at all times.

4.2 Prohibited Uses

You may not:

• Modify, alter, or tamper with the bicycle without our written consent
• Use the bicycle for commercial purposes without authorization
• Allow unauthorized persons to use the bicycle
• Use the bicycle while under the influence of alcohol or drugs
• Remove or deface any identification or branding on the bicycle

4.3 Maintenance and Repairs

We will provide regular maintenance and necessary repairs as part of your subscription. You must report any damage, defects, or issues immediately. You are responsible for any damage caused by misuse, neglect, or failure to report issues promptly.

5. Liability and Insurance

5.1 Your Responsibility

You are responsible for the safe operation of the bicycle and for any damage or loss resulting from your use, misuse, or negligence. You agree to maintain adequate insurance coverage for your use of the bicycle.

5.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

5.3 Assumption of Risk

You acknowledge that cycling involves inherent risks, including the risk of injury or death. You voluntarily assume all such risks and agree that we shall not be liable for any injuries, damages, or losses resulting from your use of the bicycle.

6. Damage and Loss

6.1 Damage Assessment

You are responsible for any damage to the bicycle beyond normal wear and tear. We will assess damage and may charge you for repairs or replacement costs.

6.2 Theft or Loss

You must immediately report any theft or loss of the bicycle to us and to local law enforcement. You are responsible for the full replacement value of the bicycle if it is stolen or lost while in your possession.

7. Return of Bicycle

Upon termination of your subscription, you must return the bicycle in good condition, normal wear and tear excepted, to a location designated by us. You are responsible for all costs associated with the return, including transportation if applicable.

8. Intellectual Property

All content, trademarks, logos, and intellectual property on our website and associated with our services are the property of ridewhee.com or our licensors. You may not use, reproduce, or distribute any such content without our prior written permission.

9. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to terminate or suspend your subscription immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or misuse the bicycle or our services.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and ridewhee.com regarding your use of our services.
