NYC E-Bike Laws

The short version: cargo bikes are legal, you don't need a license, and kids can ride along. Here's everything you need to know.

The good news

No driver's license. No registration. No DMV insurance. Electric cargo bikes are legally classified as bicycles in New York — not mopeds, not motor vehicles.

The three classes of e-bikes

New York recognizes three classes. Whee! bikes are Class 1 — the most permissive category in the city.

Class 1 — Whee! bikes

Pedal-assist only

The motor assists while you pedal and cuts off at 20 mph. Permitted everywhere bikes are allowed — including protected bike lanes and greenways.

Class 2

Throttle-assisted

Includes a throttle that can propel the bike without pedaling. Legal in NYC, but restricted on some parks and greenways.

Class 3

Speed pedelec

Pedal-assist up to 28 mph. Faces restrictions within NYC's five boroughs — not allowed in many bike lanes and paths.

Rules of the road

Bike lanes are yours Class 1 e-bikes belong in the bike lane, just like any other bicycle.
No license or registration No DMV paperwork. No insurance requirement. Just ride.
Greenways included Class 1 bikes are permitted on NYC greenways and most parks — the Hudson River Greenway, the Brooklyn Waterfront, all of it.
Standard traffic rules apply Stop at red lights, yield to pedestrians, follow posted bike signage. Same as riding any bike.

Helmets

New York state law requires helmets for riders ages 1–13. For riders 14 and older, helmets are legally optional — but strongly recommended.

Working cyclists (e.g. delivery riders) aged 16–17 are also legally required to wear a helmet.

Battery safety laws (2024–2025)

NYC passed new battery safety laws following a rise in e-bike fires from uncertified lithium batteries. All e-bikes sold in NYC must now use UL-certified batteries and chargers.
